This legislation prohibits unconscionable pricing (includes a prima facie definition) or hoarding of essential goods or services during a declaration of a state of emergency by either the President of the U.S. or the governor, or on a finding of an abnormal market disruption (defined) by a state court of general jurisdiction. Violations are a class 1 (highest) misdemeanor punishable by up to 6 months incarceration and a fine of up to $2,500 per incident for a person or $20,000 per incident for a business. The fines are deposited in the newly established Consumer Education Revolving Fund, to be administered by the Attorney General to pay costs of notices required by this legislation and for consumer education.
