Intellectual Property: Understanding the New Paradigm


An informational seminar hosted by the professionals at Polsinelli Shughart

 

On September 16, 2011, the America Invents Act, also known as the AIA or Patent Reform 

Act of 2011, was enacted into law. The AIA has been heralded as the most significant 

change to Patent Law since 1952. 

 

Many of the changes will affect the way that patents are obtained and enforced by 

companies and many long-standing patent acquisition and defense strategies will need 

to be evaluated to see if they fit within the new paradigm. 

 

This presentation will highlight some of the major changes that will be taking place 

between now and March of 2013 so that companies will have time to determine how to 

best use the new rules to their advantage.

The transition from a "first-to-invent" system to a "first-to-file" system

3rd party challenges to patent applications and issued patents

Prioritized examination

Changes in what can be considered by the Patent Office when evaluating your patent application for patentability

Ways of showing how a patent owner derived their invention from you

Changes to patent litigation.
